The debt collection industry is a monster. As in huge. It is just BIG. And pretty ugly, to boot. The volume of the business means that most debt collectors and attorneys are sloppy and all make 'mistakes.' I put the mistakes in quotes not because there is some vast conspiracy amongst debt collectors and counsel but because there is a strong business incentive to BE wrong. I know that is counter-intuitive, but work with me here. Most debtors do not know their rights, and the ones that do often try to represent themselves (which rarely works) and the fraction of those affected by mistakenly entered judgments on lawsuits they never knew about fail to reach out to FDCPA or consumer protection or debtor attorneys. (I will have a post later on how bankruptcy attorneys often cost their clients money by failing to issue spot causes of action such as described in the video. Nothing against bankruptcy attorneys ... but consumer protection is not really their 'thing'.) So the few that actually understand their rights (hopefully this video helped!) and reached competent counsel in their jurisdiction might be able to both undo the improper judgment AND SUE THE JERKS THAT ENTERED JUDGMENT IN THE FIRST PLACE. In judo parlance (I am a judo fanatic), that would be an Ippon.
