The judicial branch gets its power from Article III of the Constitution. There, provision is made for a Supreme Court, while Congress is granted the power to create inferior courts, which it did with the Judiciary Act of 1789. The Supreme Court is the highest court in the United States. Under it you have the Court of Appeals, and then at the bottom of the hierarchy is the U.S. District Courts. The most significant power the Supreme Court possesses is the power of judicial review by which the Court can determine the constitutionality of laws. This power was not explicitly given by the Constitution but rather was established in the required case Marbury v. Madison.
