In 2021, it was reported that Hyderabad police was stopping people to check their phones in the pursuit of making the city “ganja/free” But, this is NOT ALLOWED under the Indian Law. • Article 20(3) gives you a fundamental right to not be a witness against yourself I.e. you gave the RIGHT TO REMAIN SILENT • RIGHT TO PRIVACY is a fundamental right of every citizen of India Thus, legally police is not allowed to check your phone with force. However, the real life application of such rules are difficult. So what can you do? If the police stops you and forces you to give your phone, you can: • Ask them under what offence/provision/suspicion are they asking your phone? • Ask them for a legal notice/search warrant • Ask them to put their request in writing And if nothing works out, • Contact a lawyer Knowing about your rights can create huge power differential, even if situation seems adverse :)
