The dispute began in 1995, when McDonald's cancelled a contract with the Salvadoran-owned Servipronto, a franchise chain that ran several McDonald's restaurants, because of concern over the restaurants' quality. Servipronto argued that the contract, which began in 1978, could not be terminated until 2014. After several trials through the Salvadoran justice system, in 2005 the Second Civil Chamber of El Salvador ordered McDonald's to pay 23.9 (m) million US dollars in damages for terminating the franchise agreement. After McDonald's lawyers filed an appeal, the Constitutional Chamber of the Supreme Court of El Salvador ruled in 2011 that McDonalds had to pay the 23.9 (m) million US dollars. Servipronto's owner and president Roberto Bukele said the company has been forced to file a new lawsuit against McDonalds because the US company has failed to comply with the 2011 decision. At that time, McDonald's said in a statement that it regretted the Salvadorean court decision, but maintained its right to take over a franchise "to maintain our high standards and provide excellent customer service and quality food served around the world as we have done so far." Bukele said on Friday that the new lawsuit would be filed in a federal court in the United States. "This is a lawsuit made possible by a law that was passed in the US Congress, which penalises racketeering in civil and commercial trials," he said. He accuses McDonald's of "influence-peddling at all levels" in both El Salvador and in the United States in the legal dispute between the two companies.
