Possession of a Controlled Substance charges here come in two forms: actual possession and constructive possession. In this video, we'll go over the difference. It's important to note that different drugs carry different penalties in Florida. Misdemeanor charges typically involve possession of marijuana under 20 grams. However, felony charges apply to any amount of most other substances like cocaine, heroin, fentanyl, Xanax, oxycodone, and more. These felonies start as third-degree felonies, carrying a maximum of five years in prison. If you're caught with a larger quantity, you might face charges like possession with intent to sell or deliver, which is a second-degree felony punishable by up to 15 years in prison. In cases involving even larger amounts, you could be charged with trafficking, a first-degree felony with penalties up to 30 years in prison and mandatory minimum sentences ranging from three to fifteen years, depending on the substance and quantity. But don't lose hope—there are numerous defenses available. Beyond defenses, Florida offers various diversion programs, even for felony charges. These programs can lead to charges being dropped or reduced after completing requirements like community service, drug education classes, and counseling. Each of Florida's 67 counties has its own version of these programs, often known as Intervention, Diversion, PTI, PTD, Drug Court, or Second Chance programs. Successfully completing one of these programs can be a lifeline, keeping a conviction off your record. However, it's essential to be aware of the consequences of a drug conviction in Florida. Aside from potential jail or prison time, a conviction—even for a misdemeanor—results in a six-month driver's license suspension.
