Incremental Innovation w/ Sadie Khodorkovsky & Scott Milner: A Powerful Survival Tip for Legal Teams

In this ESI Survival Guide segment, we take it to the ACTUAL wilderness to discuss INCREMENTAL INNOVATION. My sidekick and I hike through upstate NY, trying our best to start a fire using nothing but materials found in the woods. WHY? You ask. Well, I parallel innovations around humans controlling fire with technological innovations in a law practice. It has been theorized that the ability of humans to manipulate fire through focused innovations led to our brains evolving more rapidly, which allowed us to leapfrog the evolutionary hierarchy. In that same vein, incremental innovation is a powerful way in which you can make major leaps towards improving your law practice, effectively leveraging technology, and gaining and maintaining competence. An important thing for all legal professionals to consider...is innovation more about technology or your mindset? Following a brief intro involving some pretty advanced teleportation skills (though I should have used them in lieu of a brisk jog back to the studio), I sit down with Sadie Khodorkovsky, an Executive Director at JPMorgan Chase and Global Head of their Legal Discovery Management Group, and Scott Milner, a Partner at Morgan Lewis & Bockius LLP and Co-Leader of their eData Practice. Sadie and Scott are two prolific, world renown experts in the eDiscovery and legal technology spaces and have been innovating at the forefront of the legal industry for years. We could not have two better guides to help us navigate the electronic wilderness in search of the hows, whys, whats and benefits of incremental innovation. After introducing these two amazing experts, including Scott's fashion prowess, we jump right into the concept of incremental innovation. We discuss how attempting to solve one problem could very well lead to solutions in new areas, finding comfort in being uncomfortable when trying to innovate, the importance of champions with any innovative effort, how to get "buy-in" for your initiatives, encouraging your team to constantly have an eye for innovation, the possibility that we have too much innovation, how refined processes can help "standardize" your approach to seemingly diverse challenges, when innovation is actually just the past repackaged, practical innovations you can use in your practice now, the importance of creativity for legal professionals, refinement as innovation, expecting constant process improvement from your team, how to define and align necessary stakeholder groups, demonstrating the benefits of innovation, going forward by looking back, not being afraid to fail (or to speak up), promoting "new intersections" within your team as a tool for innovation, the "Art of Innovation," and more. After what is now one of my favorite reactions in ESI Survival Guide history (it's a reaction to one of my comments...bonus points if you can pinpoint where), we receive some fantastic practical advice from both Sadie and Scott and conclude with an open discussion about how they innovated together as a team.
