2024 Elections | ConCourt overturns Electoral Court ruling allowing Zuma to be MK Party candidate

The Constitutional Court has upheld the IEC's appeal against the Electoral court order on former President Jacob Zuma's candidacy. Zuma was convicted of contempt of court in the Constitutional Court and sentenced to 15-months imprisonment. The IEC upheld an objection against Zuma's candidacy that he was disqualified by Section 47(1)(E) of the Constitution due to his conviction and sentence. The apex court handed down judgment this morning on the correct interpretation of Section 47(1)(E) of the Constitution - which governs who qualifies for membership of the National Assembly. The apex court has found, among other things, that the Electoral Court's reasoning cannot be sustained and that the said section focuses on the sentence imposed, NOT the sentence served. Zuma is disqualified from being a member of the National Assembly. The disqualification only ends 5 years after the sentence is completed.
