Party Boat Gets Busted By Police & Arrests Captain

Body Cam - Fish and Wildlife Officers were conducting water-based patrol near Lake Boca in south Palm Beach County. They observed a vessel traveling north in the Intracoastal Waterway and initiated a stop to conduct a boat safety inspection. Upon contacting the operator of the vessel, later identified as [REDACTED], officers noticed that [REDACTED] had slightly slurred speech and bloodshot, glassy eyes with slightly droopy eyelids. They also detected the odor of an unknown alcoholic beverage emanating from the vessel. The officers explained to [REDACTED] that they were conducting a boater safety inspection for required safety equipment. As [REDACTED] moved around the vessel, officers were able to detect a slight odor of alcohol coming from his person. Officers asked [REDACTED] if he would perform Seated Standardized Field Sobriety Tasks (SFSTs) to determine impairment, to which [REDACTED] consented. [REDACTED] boarded the officers' vessel to begin the Seated SFSTs. The officers administered the Horizontal Gaze Nystagmus (HGN), Finger to Nose, Palm Pat, and Hand Coordination tasks in a standardized order. During the HGN task, [REDACTED] exhibited clues of impairment in both eyes, including lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to a 45-degree angle. [REDACTED] showed six clues for this task, indicating impairment. In the Finger to Nose task, [REDACTED] displayed 13 clues of impairment, as he consistently missed touching his nose and failed to bring his hand back to the starting position. During the Palm Pat task, [REDACTED] demonstrated two clues of impairment by rolling his hand and not increasing speed as instructed. In the Hand Coordination task, [REDACTED] exhibited three clues of impairment. While he correctly performed the first two tasks, he failed to properly execute the return steps and the end position. Considering the totality of the circumstances, including observations of speech, eyes, odor of alcohol, and performance on the SFSTs, [REDACTED] was arrested for boating under the influence.
