Maritime Delimitation and Territorial Questions (Qatar v. Bahrain) | 1994 I.C.J. 112 The International Court of Justice frequently settles territorial disputes between nations. However, because the parties in these disputes are sovereign states, they can be subject to the Court’s jurisdiction only with their consent. In Maritime Delimitation and Territorial Questions, the Court considered whether documents signed by Qatar and Bahrain conferred jurisdiction over a maritime territorial dispute to the Court. For over twenty years, Bahrain and Qatar unsuccessfully attempted to resolve a dispute regarding sovereignty over the Hawar Islands, sovereign rights over certain shoals, and delimitation of the maritime boundary between Qatar and Bahrain. In nineteen seventy-six, the amirs of Bahrain and Qatar entered an agreement with the king of Saudi Arabia to attempt to resolve the dispute through mediation. In nineteen eighty-seven, letters were exchanged between the king of Saudi Arabia and the amirs of Qatar and Bahrain, discussing approaching the International Court of Justice, or I C J, and properly bringing the case before the Court. This included forming a tripartite committee to agree on processes and objectives for referring the matter to the I C J that were acceptable to both Qatar and Bahrain. However, after six tripartite committee meetings, the nations failed to reach an agreement on the terms for submitting the dispute to the I C J. Finally, the parties signed minutes of the meetings in December of nineteen ninety. The minutes document reaffirmed the parties’ objectives and included a stipulation that the parties could submit the dispute to the I C J if it wasn’t resolved within six months. In July nineteen ninety-one, Qatar filed an application instituting proceedings against Bahrain before the I C J, and Bahrain disputed the Court’s jurisdiction. Want more details on this case?
